Contest Rules and Regulations

Thai Kitchen Everyday Recipe Challenge Contest

Official Contest Rules

1. CONTEST PERIOD
Thai Kitchen’s Everyday Recipe Challenge Contest (the “Contest”) commences at 12:00:01a.m. Eastern Time (“ET”) on January 26th 2015 and ends at 11:59:59p.m. ET on March 18th 2015, (the “Contest Period”). This Contest is brought to you by Thai Kitchen (the “Contest Sponsor”).

2. ELIGIBILITY
The Contest is open to all legal residents of Canada who have reached the age of majority at the time of Contest entry in the Province or Territory in which they reside.

Notwithstanding the above, this Contest is not open to employees of the Contest Sponsor or of its divisions, subsidiaries, affiliates, advertising and promotional agencies, Contest suppliers and judges, members of their immediate families (parents, siblings, spouses) and those with whom they are domiciled.

3. HOW TO ENTER
NO PURCHASE NECESSARY. Entrants can enter the Weekly Contest Period (as described below) portion of the Contest and the Final Contest Period (as described below) portion of the Contest at www.thaikitchencanada.ca and/or www.simplyasiacanada.ca.

Each website is compensated by the Contest Sponsor for its participation in the Contest.

In order to Enter during the First Weekly Contest Period and the Second Weekly Contest Period (as described below), each entrant must register on the Contest Website and vote for their favourite recipe. There is a limit of one (1) vote per person per 24 hour period, per participating website, during each Contest Period is permitted.

In order to Enter during the Final Contest Period (as described below), each entrant must register on the Contest Website and vote for their favourite recipe. There is a limit of one (1) vote per person per 24 hour period during the Contest Period is permitted.

Each valid vote following a valid registration will count as one entry (an “Entry”) into the Contest. Entrants are required to submit their name, phone number and a valid email address. Only one (1) email address can be used per person. The Contest Sponsor reserves the right to disqualify Entries that it deems in its sole discretion to be harmful to individual users, Contest Sponsor, the communities that make up Thai Kitchen, or any rights of the Contest Sponsor or its affiliates or any other party, including any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful or racially offensive, ethnically offensive, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, provincial, national, federal or international law.

All fields on the registration form must be completed unless indicated as optional. By entering this Contest, you agree to abide by and be bound by these Contest rules and the decisions of the Contest Sponsor with respect to all aspects of the Contest, which decisions are final.

4. ENTRY PERIODS:

First Weekly Contest Period
The First Weekly Contest Period runs from 12:00:01a.m. ET on January 26th 2015 until 11:59.59p.m. ET February 1st 2015.

Second Weekly Contest Period
The Second Weekly Contest Period runs from 12:00:01a.m. ET on February 2nd 2015 until 11:59.59p.m. ET February 9th 2015.

Final Contest Period
The Final Contest Period runs from 12:00:01a.m. ET on February 18th 2015 until 11:59.59p.m. ET March 18th 2015.

5. OPT-IN AND BONUS ENTRIES

OPT-IN
Opt-in to receive email announcements and special offers from Contest Sponsor (optional)*.

*This part of the entry process is optional. Information collected from Entrant, as herein defined, on the online registration form may be used by Contest Sponsor as indicated in the Contest Sponsor’s Privacy Policy (including receiving email announcements and special offers from the Contest Sponsor, if Entrant elects to opt-in). If Entrant chooses not to receive email messages from the Contest Sponsor, it will not decrease their chances of winning.

BONUS ENTRIES
After entering the Contest, entrants may earn bonus entries during the First Weekly Contest Period, the Second Weekly Contest Period, and the Final Contest Period.  In order to obtain the bonus entries, entrants must share the Contest across Twitter, Facebook, Pinterest or any other social media platform set out on the Weekly Contest Websites or Final Period Contest Websites using the unique link provided on the Weekly Contest Websites (during the First Weekly Contest Period and Second Weekly Contest Period) or Final Period Contest Websites (during the Final Contest Period) after entry. Entrants will receive three (3) bonus entries (during the First Weekly Contest Period or Second Weekly Contest Period) or five (5) bonus entries (during the Final Contest Period) each time a person (other than the original entrant) uses the unique link shared by the entrant to register for and enter the Contest. If a person using a unique link to register for and enter the Contest does so during the First or Second Weekly Contest Period, the bonus entries will be in respect of the First or Second Weekly Contest Period, as applicable. If a person using a unique link to register for and enter the Contest does so during the Final Contest Period, the bonus entry will be in respect of the Final Contest Period.  To share the Contest, and therefore receive bonus entries, the entrant must have a valid Facebook, Twitter or Pinterest or other applicable social media account. 

6. PRIZES

There are a total of thirteen (13) prizes. The Contest Sponsor reserves the right to modify the prizes at any time, for any reason, at their sole discretion.

GRAND, FIRST AND SECOND PRIZES
For the entrants who enter during the Final Contest Period, there are a total of three (3) prizes.

There is one (1) Grand Prize consisting of one (1) Marvel Beverage Centre (Approximate Retail Value $2000 CDN.) There is one (1) First Prize consisting of Gordon Ramsey Maze Set, which includes: an eleven (11) piece cookware set, a seven (7) piece block set, and a seven (7) piece oven-to-tableware collection set. (Approximate Retail Value $1500 CDN.) There is one (1) Second Prize consisting of one (1) a Traeger Lil’ Tex Elite, which includes: a custom fit Hydrotuff cover and one (1) bag of Premium Traeger wood pellets. (Approximate Retail Value $1000.00 CDN).

WEEKLY PRIZES
There are ten (10) Weekly Prizes. There is one (1) prize per person, per week, to be won. Five (5) during the First Weekly Contest Period and five (5) during the Second Weekly Contest Period.

The First Weekly Prize (for entrants who enter during the First Weekly Contest Period) consisting of: a set of six (6) Dreamfarm Kitchen Gadgets (Approximate Retail Value $150.00 CDN). The model and other details regarding the First Weekly Prize shall be determined by the Contest Sponsor.

The Second Weekly Prize (for entrants who enter during the Second Weekly Contest Period) consisting of: a Moulinex Infiny Press Slow Juicer (Approximate Retail Value $300.00 CDN). The model and other details regarding the Second Weekly Prize shall be determined by the Contest Sponsor.

7. PRIZE DRAWS:

WEEKLY PRIZE DRAWS:

Five (5) potential winners will be randomly selected from all eligible entries received during the First Contest Entry Period (one (1) potential winner from votes cast for each Blogger) at 12:00 noon ET on February 10th 2015 at 846 College St. Unit 3, Toronto, ON M6H 1A2 by a representative of the Contest Sponsor. Entries not selected for a First Weekly Prize will not be carried forward for future draws. Limit one (1) First Weekly Prize per household.

Five (5) potential winners will be randomly selected from all eligible entries received during the Second Contest Entry Period (one (1) potential winner from votes cast for each Blogger) at 12:00 noon ET on February 16th 2015 at 846 College St. Unit 3, Toronto, ON M6H 1A2 by a representative of the Contest Sponsor. Entries not selected for a Second Weekly Prize will not be carried forward for future draws. Limit one (1) Second Weekly Prize per household.

We will attempt to contact the selected entrants by telephone and/or email within three (3) business days of the draw date (“Initial Notification”), with further information on how to claim the Prize. If the selected entrant cannot be reached or fails to respond to Initial Notification, for whatever reason, within three (3) business days, another entrant may be randomly selected from the remaining eligible entries or the prize may be cancelled at Contest Sponsor’s sole discretion.

Odds of being selected to win a Weekly Prize in this Contest will depend on the total number of eligible entries received during the First or Second Contest Entry Period. Before being declared a winner of a Weekly Prize, selected entrant must correctly answer, unaided, a time-limited, mathematical skill-testing question and complete, sign and return a Declaration and Release Form (and any other documents, as applicable) within 7 days of receiving the Declaration and Release Form (the “Prize Claim Date”). If a selected entrant cannot be reached within the timeframe specified above, is not in compliance with these Contest rules, incorrectly answers the skill-testing question, declines the prize, email correspondence between Contest Sponsor and selected entrant is returned as undeliverable without a forwarding address, or fails to return the Declaration and Release Forms (and any other documents, as applicable) by the Prize Claim Date, the prize may not be awarded and Contest Sponsor reserves the right to randomly select another entry from the remaining eligible entries at Contest Sponsor’s sole discretion. The Weekly Prize will be delivered to an address in Canada within approximately 6 weeks from date on which a winner is verified.

GRAND, FIRST & SECOND PRIZES
Three (3) potential winners will be randomly selected from all eligible entries received during the Final Contest Entry Period at 12:00 noon ET on March 27th 2015 at 846 College St. Unit 3, Toronto, ON M6H 1A2 by a representative of the Contest Sponsor. The Grand Prize draw will be conducted first followed by the First Prize draw and then the Second Prize draw. Limit one (1) prize per household in respect of the Final Contest Period Entries.

We will attempt to contact the selected entrants by telephone and/or email within three (3) business days of the draw date (“Initial Notification”), with further information on how to claim the Prize. If the selected entrant cannot be reached or fails to respond to Initial Notification, for whatever reason, within three (3) business days, another entrant may be randomly selected from the remaining eligible entries or the prize may be cancelled at Contest Sponsor’s sole discretion.

Odds of being selected to win the Grand, First or Second Prize in this Contest will depend on the total number of eligible entries received during the Final Contest Entry Period. Grand, First or Second Prize will be delivered to an address within Canada within approximately 6 weeks from date on which a winner is verified.

7. GENERAL
All prizes must be accepted as offered and/or awarded and may not be transferred, exchanged or substituted, whether for cash or otherwise except as expressly provided in these Contest rules or at the Contest Sponsor’s sole discretion. The Contest Sponsor reserves the right to substitute a prize or portion thereof with one of at least equal value, including in the event of the unavailability, for whatever reason, of the advertised prizes. If, for any reason, more than the advertised number of prizes are claimed, there may be a random draw conducted amongst all eligible prize claimants, at Contest Sponsor’s sole discretion, to award the correct number of prizes after the Contest closing.

In the event of any dispute regarding the interpretation of these Contest rules, the decision or interpretation of the Contest Sponsor shall prevail.

All entries become the property of the Contest Sponsor. Any entry that is illegible, incomplete, altered, or contains false information, is invalid. Contest Sponsor is not responsible for lost, stolen, delayed, damaged or misdirected claims or entries or votes or for any problems or technical malfunction of any internet or telephone network or broadcast transmission during the Contest Period. The Contest Sponsor is not responsible for any errors or omissions with respect to the printing or advertising of this Contest and reserves the right to withdraw, amend or cancel this Contest in the event of a printing or administrative error. Subject to the approval of the Régie des alcools, des courses et des jeux in respect of residents of Québec, the Contest Sponsor in its sole discretion withdraw, amend, cancel, suspend, terminate or modify this Contest in any way, in whole or in part, without notice, for any reason including if it determines in its sole discretion that this Contest is no longer capable of running as intended, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause of any nature whatsoever.

The Contest Sponsor accepts no responsibility for loss, damage or claims caused by the awarded prizes or the Contest itself. By entering, entrant releases and holds harmless Contest Sponsor, its affiliated and related companies and advertising, promotional agencies and all of their respective directors, officers, shareholders, employees, agents, successors and assigns (collectively, the “Contest Entities”) from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Contest or any prize won. Winner must comply with any applicable manufacturer warranty, terms and conditions and/or user guide for any prize won.

Without limiting the release of liability provisions herein, and for greater certainty, the Contest Entities will not be liable for: a) any incorrect or inaccurate information, whether caused by users of the Weekly Contest Websites, the Final Period Contest Websites or by any equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest; b) any error, omission, interruption, deletion, defect or delay in operation of the Weekly Contest Websites, the Final Period Contest Websites or any transmission in connection with the Contest; c) any communications line failure, theft, destruction or unauthorized access to, or alteration of, entries; d) any problems with, or technical malfunction of, any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, or failure of email which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof; or e) any injury or damage to entrants’ or to any other person's computer related to or resulting from participating or downloading materials in this Contest.

Entries must be made only by the original, manual keystrokes of the individual entrant. Use of any automated system including robotic or form filling software to enter or participate is prohibited and will result in disqualification of all entries by anyone using such assistance.

In the event of a dispute as to who submitted an email entry, the entry will be deemed to have been submitted by the Authorized Account Holder of the email address submitted at the time of entry as determined by the Contest Sponsor. “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Entrants may be required to provide the Contest Sponsor with proof that he/she is the Authorized Account Holder of the email address associated with such Entry.

The Contest Sponsor reserves the right at its sole discretion to disqualify any individual from the Contest, and to ban that individual from participation in any future promotion of the Contest Sponsor, if the Contest Sponsor finds or believes such individual to be tampering with the entry process or the operation of the Contest or where applicable, the Weekly Contest Websites or the Final Period Contest Websites; to be acting in violation of the Contest rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass the Contest Sponsor, the Contest Sponsor’s agencies, other entrants or any other person. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. The Contest Sponsor’s failure to enforce any term of these Official Contest Rules shall not constitute a waiver of that provision. 

By entering this Contest, you consent to the Contest Sponsor’s use, should you become a winner, of your name, place of residence and photograph or other likeness for publicity, advertising or informational purposes in any media or format (including the Internet) now or hereafter known throughout the world in perpetuity, without further compensation, notification, or permission, unless prohibited by law, in connection with this Contest or future similar contests. By entering, you declare that you have complied with the Contest rules.

The Contest Sponsor is collecting personal data about the entrants for the purpose of administering this Contest. No further informational or marketing communications will be received by entrants unless the entrant opts-in. The Contest Sponsor respects your right to privacy of your personal information. This Contest is subject to all applicable laws and shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.

The invalidity or unenforceability of any provision of these Contest rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Contest rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or Pinterest or any other social media website. Facebook, Twitter and Pinterest and all other social media websites are completely released of all liability by each entrant in this Contest. You understand that you are providing your information to the Contest Sponsor and not to Facebook, Twitter or Pinterest or any other social media website.

Quebec Residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

These rules are also available on the www.thaikitchencanada.ca and www.simplyasiacanada.ca websites. The names of the winners may also be obtained on these websites until December 15th 2015.
